Cushman & Wakefield has made available its 2023 DC BEPS Compliance Guide, which was produced to help property management teams and owners in Washington, DC remain at the forefront of DC’s new energy ordinance.

With Washington, DC’s Building Energy Performance Standard (BEPS) now in effect, all buildings 50,000 square feet and larger are required to meet minimum energy performance targets. Starting in 2026, the BEPS will also apply to buildings 25,000 square feet and larger, and 10,000 square feet and larger in 2032.

To evaluate compliance, the city has set benchmark Energy Star scores for each property type based on 2019 benchmarking data. Buildings that exceed the benchmark of their property type comply with cycle 1 and will be re-evaluated for cycle 2 in 2027 (based on 2026 data). Buildings with 2019 Energy Star scores below their benchmark were placed in a five-year compliance cycle.

Building owners who fail to meet compliance standards will face penalties, including fines and the possibility of being listed publicly as noncompliant. Additionally, buildings that do not meet the standard will be subject to a five-year compliance cycle and must implement energy efficiency measures to reduce energy use in their buildings.

Building owners have until April 1, 2023 to choose one of three pathways to meet energy performance requirements:

Performance Pathway: Building owners following this pathway can implement energy efficiency measures of their choosing to reduce energy use in their buildings. Compliance under the Performance Pathway is achieved by a 20% reduction in Adjusted Site EUI (or weather normalized EUI for buildings that can’t receive an adjusted site EUI) from the 2019 baseline by the end of the Compliance Cycle. The Performance Pathway is open to all property types.

Standard Target Pathway: This pathway gives building owners flexibility on how to meet the energy performance requirement, meaning building owners can choose the measures they think are best for reducing energy use in their building. Compliance under the Standard Target Pathway is achieved by reaching or exceeding the 2019 Benchmark Score by the end of the Compliance Cycle.

Prescriptive Pathway: The Prescriptive Pathway is an action-based compliance method that includes reporting milestones and implementing one or more recommended EEMs designed to achieve energy savings comparable to the Performance Pathway (targeting 25% savings). Compliance under the Prescriptive Pathway is met by successfully completing specific actions and meeting reporting/verification requirements as defined by DOEE.
